What benefits can I expect to receive? Employees injured on the job can receive both income and medical benefits. Income benefits are classified as either temporary total disability benefits (TTD), temporary partial disability benefits (TPD) and permanent partial disability benefits (PPD). Catastrophic injuries can result in payment of TTD for life. These benefits are usually a percentage of your income, up to a cap. You will also receive medical treatment prescribed by your authorized treating physician.

Does every employer have to carry workers' compensation insurance? Any employer with three or more employees must carry this type of insurance or be self-insured against work injury claims. Certain employers are exempt.

What kinds of injuries are covered? Any injury that arises of and during the commission of your employment should be covered. This includes some injuries that take place between the parking lot and your place of employment. This also includes repetitive stress injuries, injuries that occurred while you were working for your employer, and occupational illnesses such as those caused by chemical exposure, toxins in the environment or exposure to contagious illnesses. Your employer does not have to be at fault for you to file a claim.

Can I pay my lawyer out of my workers' comp award? Generally, attorneys who help with your claim are paid from a percentage of benefits. The amount lawyers can charge is regulated by law.
